Alicia Paller helps clients across industry sectors litigate novel and challenging cybersecurity issues, with a particular focus on health information, class action and multijurisdictional litigation, and the intersection between civil litigation and federal and state regulatory investigations.  

Alicia brings soup-to-nuts experience to data breach and class action litigation—drafting and arguing dispositive motions, managing affirmative and defensive discovery, defending and taking fact, expert, and third-party witness depositions, opposing class certification, and preparing high-stakes pretrial motions. She develops litigation strategies that advance client objectives while helping shape precedent in a rapidly evolving legal landscape.  

Alicia also guides clients through the most urgent moments of a cyberattack, widespread service disruption, or insider threat event. Working seamlessly with legal counsel, security officers, and forensic experts, Alicia develops early strategies to mitigate risk and coordinate responses to regulators and litigants. Alicia is a go-to advisor when responding to State AG and Office for Civil Rights inquiries, navigating privilege issues, and conducting internal investigations involving security or PHI.

Alicia maintains an active pro bono practice that includes regularly appearing in civil and criminal court on behalf of survivors of violent crimes, and civil litigation on behalf of separated families and LGBTQ clients. Alicia received Volare’s “Firm Voice Award” for her team’s tireless work on behalf of survivors. Alicia also co-authored the Brief for Amici Curiae American Historical Association and Organization of American Historians in Support of Respondents (Jackson Women’s Health Org., et al.) in Dobbs v. Jackson Women’s Health Org., et al. 

Representative experience

Obtained early dismissal on the pleadings in privacy action against academic health care institution.

Defended leading technology/app company in class actions arising from a cyberattack, resulting in wins enforcing arbitration agreements.

Defended internet advertising company accused of violating consumer privacy under common law and state statutes.

Assisted health care clients in responding to cybersecurity incidents and privacy- and cybersecurity-related HHS investigations.
